FREE Versus Paid Online Dating Sites

Online Dating isn't as simple as it once was. In 2006, a law called International Marriage Broker Act (IMBRA) changed the online dating scene as we once knew it. Categorizing online dating sites now requires some understanding of the law and why they operate the way they do. Let's look at some of the possible types of dating sites that may exist today in the era of IMBRA.

Free Dating Site
These are U.S. dating sites that are required by law to comply with IMBRA and are in compliance. These are mostly U.S. sites that have non-U.S. ladies as clients and their international business is more than 50% of their total business. Male clients are required to fill out a background form. Under IMBRA certain types of U.S. sites are exempted from the law. The exemptions are based on many factors but one of the major factors is the dating site's international business be less than 50% of it's total business. Another example of an exempted IMBRA site is religious dating sites. These are sites that operate outside the U.S. For example, a dating site in England. However, a U.S. male has to be careful. The law is not clear yet if a lady's visa will or will not be denied for the U.S. if a U.S. male meets a lady through a non-U.S. site that does not comply with IMBRA. Basically these are sties that are not exempted from IMBRA and are in violation of the law. Why they are not in compliance may be for many reasons, including the fact they do not understand the law and if it applies to their site or not. Under IMBRA Free Dating Sites are exempted from IMBRA. The law stipulates that a site can be exempted from IMBRA if they charge the same fee for both the male and lady member. In our case, we charge no fees to be a member of Filipina Eyes sites.

Reading IMBRA is not fun, but the following applies to our sites:

"...If you met your fiancee(e) or spouse through the services of an international marriage broker, you must notify USCIS of that fact by answering Question 19 on this form. The term “international marriage broker” means a corporation, partnership, business, individual, or other legal entity,whether or not organized under any law of the United States, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States citizens or nationals or aliens lawfully admitted to the United States as lawful permanent residents..."

Since IMBRA became law, most of the smaller mom and pop sites went Free since they could not afford the cost to run their site under IMBRA. No background form is required to be sent to the ladies from male clients if they are a member of a FREE dating site.

I don't know if it is possible to bottom line such a vague and often misinterpreted law. Most FREE dating webmasters are asked if their site qualify as an International Marriage Broker site when filling out the I-129F (Petition for Alien Fiance). Since FREE sites are exempted from IMBRA, they are not considered an International Marriage Broker. If you are not certain, you can always consult an Immigration Lawyer.
